April 7 Webinar Helps Prepare for Completing Assisted Living Licensure Application Form

While Minnesota’s Assisted Living Licensure application form is not yet final and published, we expect it will be public on or about May 1. That leaves just a few short weeks for providers wanting to become licensed assisted living settings to complete their application in time to meet the June 1 deadline already in statute. MN Statute 144G.12 outlines several requirements that we expect to be on the application form, and you can start preparing now.

Assisted Living Licensure Rules Report Deadline Extended

The Department of Health’s proposed rules governing assisted living facilities are pending before Administrative Law Judge (ALJ) Ann O’Reilly. We anticipated that ALJ O’Reilly would issue her Rule Report last week. Instead, Chief Administrative Law Judge Jenny Starr issued an order extending the deadline allowing until Monday, March 29, to complete the Rule Report.
MDH responds to Legal Study Group’s Questions on ALL

The Minnesota Department of Health (MDH) recently provided helpful responses to several questions posed by a group of stakeholders regarding assisted living licensure.
MDH convened a group of stakeholders, including LeadingAge Minnesota and many of our legal business partner members, to address legal questions related to licensure of assisted living settings. MDH Initiates Workgroup to Address Residents Relocation During AL Licensure

MDH has convened a group of stakeholders to discuss processes and concerns that may arise related to a need for a resident to relocate due to the upcoming assisted living licensure implementation. The Department anticipates that, in some situations, a current provider may decide to discontinue services rather than pursue licensure, and that some providers may close.

In preparation for licensure of Minnesota’s assisted living settings on Aug. 1, LeadingAge Minnesota has prepared several new tools to help you prepare for implementation.
Assisted living settings will be required to apply for licensure by June 1. Although the rules have not yet been finalized and legislative discussions continue, it is important to prepare for your setting’s application for licensure and for implementation. To aid you in your efforts, we have launched tools and checklists to help you as you prepare for licensure:
Work to Craft Assisted Living Licensure Technical Legislation Stalls

Over the past several weeks, the Minnesota Department of Health (MDH) has convened provider, consumer and agency stakeholders in a series of meetings to identify additional changes to the assisted living licensure law in order to pass a bill during the 2021 legislative session. The goal was to reach stakeholder consensus on a set of changes that are critical to the smooth, timely implementation of the assisted living licensure law later this year and work with lawmakers to pass those changes in this legislative session.

DHS Works to Align Customized Living with Assisted Living Licensure

On Feb. 18, DHS sent a communication to all enrolled customized living providers about new assisted living facility licensure requirements and how they affect providers’ ability to provide customized living services. The communication was sent to each provider’s MN-ITS.

Legacy Licensed Assisted Living Director Application Slated for April

Last week, the Board of Executives for Long Term Services and Supports (BELTSS) updated the projected time frame for licensed assisted living director (LALD) applications to be available. We now anticipate that the applications will be available in April for those eligible as legacy directors.

Public Comment Period on Assisted Living Licensure Concludes

The public comment period on the proposed rules for assisted living closed on Tuesday, Feb. 9 at 4:30 p.m. In addition to comments provided during the public hearing held Jan. 19 and 20, over 275 were submitted to the administrative law judge (ALJ) on the topic of assisted living licensure.
